§ 1
Seller’s Details

§ 2
The purpose of the sales contract
1 MOTO-MARKETING sells goods via eBay – an online trading platform.
2 The Customer purchases the goods as follows: a buyer chose the item and clicks “Buy It Now” button, this opens a new webpage where a buyer can confirm the purchase of the goods. The agreement is made when purchase is confirmed. Before confirming, the Customer can verify the order details and correct any errors in the order. After the Customer confirms the purchase MOTO-MARKETING immediately acknowledges receipt of the order.
3 MOTO-MARKETING is bound by the offer for each item until the end of “Buy It Now” auction.
4 MOTO-MARKETING does not store sales contracts. Therefore the text of the sales contract will not be saved by MOTO-MARKETING or available to the Customer. If the Customer wants to save the text of the agreement, the Customer can print a screen shot of the sales contract. The Customer can access the details of the purchase via eBay web portal for 90 days from the date of “Buy It Now” purchase. After this period, the transaction details are no longer stored by eBay.
5 Sales contracts are made in English language.
6 If the goods ordered by the Customer are out of stock, or if the order cannot be executed owing to circumstances beyond MOTO-MARKETING control within timescale provided for carrying out orders MOTO-MARKETING will inform the Customer of the situation by e-mail to the address provided by the Customer at registration.
7 If it is not possible to carry out any part of the order, the Customer can:
7.1 cancel the entire order (if a Customer chooses this option, MOTO-MARKETING will be released from obligation to carry out the order);
7.2 cancel the part of the order that cannot be executed within timescale provided for carrying out order (if a Customer chooses this option, order will be executed in part and MOTO-MARKETING will be released from obligation to carry out the outstanding scope of this order);
7.3 select a substitute item - if this option is chosen, MOTO-MARKETING may offer Customer a replacement product. The Customer may, within 14 days of receipt of the goods, return the goods to MOTO-MARKETING. In this case, MOTO-MARKETING will be responsible for the costs of transport to return the goods.
8 Each party shall be entitled to withdraw from the contract within 14 days from making the agreement if agreement was made during a time when the eBay system was malfunctioning, in particular eBay displayed incorrect pricing or product descriptions. If payment for the product had been made in advance, MOTO-MARKETING will refund the amount paid within 14 (fourteen) days of the date of sending the notice of withdrawal (in the case of withdrawal by MOTO-MARKETING), or from the date of notification of withdrawal by the Customer. Termination of the contract shall be made in writing and sent to the other party address.

§ 3
Prices of products
1 Prices of goods provided by MOTO-MARKETING include all duties and taxes but do not include shipping costs.
2 The shipping cost is given in the section: Postage and payments.
3 Along with the ordered goods, Customers receive the instructions for use, these Terms and Conditions, form to cancel the agreement and proof of purchase.
4 A VAT invoice will be issued upon request. If the Customer is VAT registered then the Customer should inform MOTO-MARKETING and a VAT invoice will be issued.
§ 4
Method of payment
1 The MOTO-MARKETING payments shall be made by PayPal.
2 Payment method is given in the section: Postage and payments.
§ 5
Terms of delivery of ordered goods
1 With every “Buy It Now” offer order’s processing time is displayed.
2 The manner and time of transport and packaging is calculated from the moment the full amount of the purchase price arrives into MOTO-MARKETING PayPal account. The manner and time of transport and packaging for each item is provided in the tab: Postage and payments.
§ 6
Cancellation and contract termination
1 The Customer who purchases at MOTO–MARKETING may withdraw from the sales contract without giving reasons, by serving written notice, within 30 (thirty) days of receipt of goods. To comply with this deadline, the Customer must send such notice before the 30 days expires by mail or e-mail to MOTO-MARKETING.
2 Upon termination of the contract, the agreement shall be considered null and void, and the Customer is released from any obligations.
3 MOTO-MARKETING will reimburse all payments received from the Customer without undue delay and in any event not later than 14 days from the date on which it was notified of the termination.
4 The Customer must return the goods without undue delay and not later than 14 days after providing MOTO–MARKETING with notice of cancellation or termination.

6. Subject to clause 2 paragraph 7.3, the Customer is responsible for direct cost of returning the goods.
7 We kindly ask, if it is possible, to return all goods in good and merchantable condition.
§ 7
Complaints
1 MOTO-MARKETING makes every effort to ensure that Customers are satisfied with the purchased goods. MOTO-MARKETING is committed to provide goods as described in offer. In the event the Customer is not fully satisfied with a service or product received, a written complaint can be made to the following address:

2 MOTO-MARKETING will respond to the complaint no later than 5 business days from the date of its receipt.
§ 8
Personal information
1 A Customer's personal details such as, but not limited to, name, address, e-mail address, telephone number will be collected by MOTO-MARKETING only for the purpose of processing Customer orders made from MOTO-MARKETING to the extent necessary to implement the agreement to which the Customer is a party or to the extent that it is necessary to be able to carry out any action before the completion of the contract that may have been requested by the Customer.

3 Personal information is protected under the Data Protection Act 1998 or any subsequent legislation as may be implemented from time to time in a way that prevents access by third parties.
4 Should a Customer wish to find out what personal data MOTO-MARKETING holds on them then they are entitled to make a request direct to MOTO-MARKETING sent to the following address:.

§ 9
Final provisions
1 All goods supplied by MOTO-MARKETING comes from a legitimate source.
2. This Contract shall be governed by and construed according to the laws of England and Wales and the parties submit to the exclusive jurisdiction of English Court.
3 These Terms and Conditions take effect on 15.11.2013
4. The terms of this Contract represent the entire agreement between the Customer and MOTO-MARKETING with regards to the provision of the subject matter of this Contract and supersede any previous representations or agreements whether recorded in writing or otherwise.
