Allgemeine Geschäftsbedingungen
§ 1 Geltungsbereich
Für die den Kauf von Krippenfiguren zwischen Kai Kunze und dem Besteller gelten die nachfolgenden Allgemeinen Geschäftsbedingungen in ihrer zum Zeitpunkt der Bestellung gültigen Fassung.
§ 2 Vertragsschluss
Ihre Bestellung stellt ein Angebot an uns zum Abschluss eines Kaufvertrages dar. Der Verkaufsprozess wird hierbei durch das ebay-System abgewickelt. Der Kaufpreis enthält nur die Differenzbesteuerung.
§ 3 Widerruf
Verbraucher können bei Bestellung über das Internet oder fernmündlich schriftlich (auch per E-Mail) oder durch Rücksendung der Ware innerhalb von 14 Tagen nach Erhalt der Ware den Vertrag widerrufen. Für die Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Ware. Die Versandkosten trägt der Kunde, wenn die gelieferte Ware der bestellten Ware entspricht. Ein Widerrufsrecht besteht nicht, wenn eine Ware eigens für den Kunden angefertigt wurde oder für den Kunden auf besonderen Wunsch baulich verändert/ modifiziert wurde, oder wenn die Figuren persönlich übergeben wurden. Der Widerruf muss keine Begründung enthalten und ist per Brief, Fax, E-Mail oder per Email Nachricht zu erklären; zur Fristwahrung genügt die rechtzeitige Absendung des Widerrufs oder der Ware. Die Frist beginnt frühestens mit Erhalt dieser Belehrung. Diese Option gilt nur für private Käufer, nicht für Unternehmer. Die Kosten der Rücksendung trägt der Verbraucher. Vom Kaufpreis werden die an, oder von Kai Kunze bezahlten Versandkosten abgezogen. Bei Rückzahlungen ins Ausland werden zudem die Überweisungsgebühren abgezogen.
§ 4 Lieferung
(1) Kai Kunze liefert die Ware nach Eingang der Zahlung an die vom Käufer angegeben Versandadresse. Versand erfolgt durch DHL oder DPD.
(2) Die Ware ist umgehend nach Empfangnahme durch den Käufer oder seinen Beauftragten auf Transportschäden zu untersuchen. Feststellbare Transportschäden sind unverzüglich schriftlich anzuzeigen. Verpackungsschäden muss sich der Käufer bei Annahme der Ware von dem Transportunternehmen schriftlich bestätigen lassen
(3) Die Lieferung erfolgt an die vom Käufer angegebene Lieferadresse. Ist der Kunde Unternehmer (§ 14 BGB), so trägt er beim Versand nach § 447 Abs. 1 BGB die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der Kaufsache. Bei einem Verbraucher (§ 13 BGB) bleibt es bei der gesetzlichen Regelung des § 474 Abs. 2 BGB.
§ 5 Fälligkeit und Zahlung
Vorabüberweisung mit Erhalt einer Rechnung als PDF oder Ebay-Rechnung/Kaufbestaetigung.
§ 6 Aufrechnung, Zurückbehaltung
Ein Recht zur Aufrechnung steht dem Besteller nur zu, wenn seine Gegenansprüche rechtskräftig festgestellt oder von Kai Kunze unbestritten sind. Außerdem ist er zur Ausübung eines Zurückbehaltungsrechts nur insoweit befugt, als sein Gegenanspruch auf dem gleichen Vertragsverhältnis beruht.
§ 7 Eigentumsvorbehalt
Die gelieferte Ware bleibt bis zur vollständigen Bezahlung im Eigentum von Kai Kunze.
§ 8 Mängelhaftung
Liegt ein Mangel der Kaufsache vor, gelten die gesetzlichen Vorschriften der §§ 434 ff. BGB. Die Abtretung dieser Ansprüche des Käufers ist ausgeschlossen.
§ 9 Anwendbares Recht
Es gilt deutsches Recht.
§ 10 Die salvatorische Klausel gem. § 306 BGB findet Anwendung

General Terms and Conditions of Business
§ 1 Area of application
For the purchase of nativity figures between Kai Kunze and the customer, the following General Terms and Conditions apply in the version valid at the time of the order.
§ 2 Conclusion of contract
Your order represents an offer to us to conclude a sales contract. The sales process is handled by the ebay system. The purchase price includes only the differential taxation.
§ 3 Revocation
Consumers can cancel the contract when ordering via the Internet or by telephone in writing (also by e-mail) or by returning the goods within 14 days after receipt of the goods. The timely dispatch of the revocation or the goods is sufficient for the observance of the revocation period. The customer bears the shipping costs if the delivered goods correspond to the ordered goods. A right of revocation does not exist if a product was specially made for the customer or was structurally changed/modified for the customer on special request, or if the figures were handed over personally. The revocation does not have to contain a reason and is to be explained by letter, fax, email or by email message; for the period preservation the punctual sending off of the revocation or the commodity is sufficient. The period begins at the earliest with receipt of this instruction. This option applies only to private buyers, not to entrepreneurs. The consumer bears the cost of return.
§ 4 Delivery
(1) Kai Kunze delivers the goods after receipt of payment to the shipping address specified by the buyer. Shipping is done by DHL or DPD.
(2) The goods have to be checked for transport damages immediately after receipt by the buyer or his representative. Any ascertainable transport damage must be reported in writing without delay. The Buyer must obtain written confirmation of packaging damage from the transport company upon acceptance of the goods.
(3) Delivery shall be made to the delivery address specified by the Buyer. If the customer is an entrepreneur (§ 14 BGB), he shall bear the risk of accidental loss and accidental deterioration of the purchased item during shipment in accordance with § 447 para. 1 BGB. In the case of a consumer (§ 13 BGB), the statutory provision of § 474 para. 2 BGB shall apply.
§ 5 Due date and payment
Advance transfer with receipt of an invoice as a PDF or Ebay invoice / purchase confirmation.
§ 6 Set-off, retention
The purchaser only has the right to offset if his counterclaims have been legally established or are undisputed by Kai Kunze. Furthermore, he is only authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.
§ 7 Retention of title
The delivered goods remain the property of Kai Kunze until full payment.
§ 8 Liability for defects
If there is a defect in the purchased goods, the statutory provisions of § § 434 et seq. BGB. The assignment of these claims of the buyer is excluded.
§ 9 Applicable law
German law shall apply.
§ 10 The severability clause according to § 306 BGB shall apply.
