Please note that if you access and use our website and order any of our products, you agree to the terms and conditions.
We welcome your enquiries, comments and suggestions.
Ordering products
You order a product listed on the website for sale by clicking on it and placing in your virtual basket. Please review your orders by checking the basket, before you move on to the checkout to submit your order. Once you place an order, we will send you and e-mail with a confirmation that it has been received and is being processed. This e-mail will not constitute an acceptance of your order. When we accept your order, we will send you an e-mail informing you that we dispatched the items. This is the confirmation that there is a legally binding contract formed between you and us.
If the product is discontinued or out of stock, or if the payment from you cannot be authorised, we will be unable to accept your order and we will not be liable to you or anyone else. Under the distance selling regulations you have a legal right to cancel your order within 7 working days from the date of receipt of the products.
The products will be owned by you when they are delivered to you or when we receive full payment for them (including delivery charges). We are liable for the products delivered only if they are damaged or faulty, or delivered incorrectly. We are not liable for products delivered to you that are subsequently lost, damaged or destroyed.
Content, price and payment
We try hard to provide accurate prices and content (such as descriptions and images of products). The information about the products (descriptions, colours, photographs, ingredients) is displayed on the website as provided by the manufacturer or the wholesaler agent. The Scent of Berries is not responsible for omission or errors in this information.
All products are subject to availability and confirmation of the order price. If the items you ordered are out of stock or discontinued, we will inform you as soon as possible.
The prices of products are quoted on the website. They include VAT and exclude package and delivery costs. Delivery cost will be added in the checkout process. Sometimes errors might happen and we will correct these as soon as possible. If you order a product at incorrect price, we will contact you before accepting your order, so you can either cancel your order or reconfirm it at the correct price. If we cannot contact you we will treat your order as cancelled. The Scent of Berries has the right to correct errors in prices without prior notice.
Prices can change, but not after you received the confirmation of dispatch. Your order will only be processed once we received full payment for all products it contains. Payment can be made with credit and debit cards, as well as paypal. You will see the payment options during checkout.
As a holder of the credit/debit card used to make the purchase you will be subject to validation checks and authorization by the card issuer. If the authorization fails or if you do not have sufficient funds to buy the goods, we cannot accept your order and we are not responsible for any delays or not delivering your order, and we do not need to inform you about the reason. Your card issuer or bank might charge you as a result of us processing our card. We are not liable for such charges. The legal ownership of the products is transferred to you only after we received full payment, and transferred back to us if we refund the payment to you.
Our liability
We are not liable for losses that could not have been reasonably foreseen. Neither are we responsible for events outside of our control, which may cause delays in delivery or failure to fulfil our obligations. The Scent of Berries is not responsible for any damages, injury or illness caused by inappropriate use of the products or by an allergic reaction. It is your responsibility to read the product instructions and make sure you understand them before you use the product.
No part of our Terms & Conditions affects your statutory legal rights.

Information, logos and images on The Scent of Berries website are the property of The Scent Of Berries and are protected by copyright laws. They must not be reproduced without the expressed permission from The Scent of Berries. © The scent of berries 2015.
Should any of these Terms and Conditions be confirmed as invalid, unlawful or unenforceable, we will delete this provision, and the other provisions will remain in full force and effect. We can amend and update the Terms and Conditions without prior notice by posting the changes on the website. This will not affect the orders placed before the changes.
Any disputes between you and The Scent of Berries will be governed by English Law.

The material displayed on www.thescentofberries.co.uk is provided without any guarantees, conditions or warranties as to its accuracy. The Scent of Berries excludes all conditions, warranties and other terms, whether express or implied, including any guarantees of quality, non-infringement or fitness for purpose, except expressly stated to the contrary to the fullest extent permitted by law.
Delivery
Orders placed on the website are usually despatched within 2 working days of receipt. Standard deliveries should reach you within 7 working days. If you are still waiting for your products after then, we would re-send your items, whilst claiming a failed or lost delivery with Royal Mail.
Sometimes your order might be waiting at the local sorting office, even if there was no note or card left at your house. You need to check with them before informing us that your order delivery failed.
