These are Mountain Goat Performance Ltd (‘MGP’) Store Terms and Conditions of sale to which all online purchases are subject. We reserve the right to change these terms and conditions at any time, without notice. Any changes will take effect when posted on this website. By using this website you agree to be bound by these Terms and Conditions.
These Terms and Conditions do not affect your statutory rights.
2. The contract
Acceptance of your order and the completion of the contract between us (Mountain Goat Performance Ltd) and you, (the customer), will take place when the goods have been paid for by you and despatched by us. Any email, order confirmation or other electronic acknowledgement by us of receipt of an order does not constitute legal acceptance by Mountain Goat Performance Ltd of your order. We will notify you by email that order has been shipped and the method used to ship the goods to the address specified by you.
In the event that there are any errors regarding price or description, we reserve the right to notify you as soon as possible and give you the options to proceed with this revised order at the correct price/description, or to cancel the order. In these circumstances, upon cancellation, your credit/debit card will be refunded in full. In the event that we are unable to supply due an issue with a third party supplier, we reserve the right to notify you as soon as possible and give you the option to change or cancel your order. In these circumstances, upon cancellation, your credit or debit card will be refunded in full.
3. Pricing
The prices shown against each item will include delivery unless otherwise specified.
All and any special offers are subject to availability and while stocks last.
All prices are shown in £ sterling and include V.A.T. where appropriate. We regret we are not able to offer VAT exclusive pricing for deliveries to the Channel Islands or any non EU state. Please contact us via email to sales@mountaingoatperformance.eu before ordering if you live in a non-EU country or state.
If an administrative error has resulted in an incorrect price being displayed, we reserve the right to correct that price and notify you accordingly. In these circumstances, it will be deemed that a contract has not been entered into and you will not be bound to continue with your purchase. You will be asked to email us to confirm that you wish to proceed at the correct price, however, should you choose not to do so, and your monies will be refunded to your credit/debit card in full. The repayment of such monies paid to us will be the extent of our liability to you in the event of pricing errors.

4. Ordering goods
Our online store can only accept orders originating from and for delivery to UK & EU addresses. We can ship to other countries but you need to contact us prior to ordering. Please email sales@mountaingoatperformance.eu
To order goods from our online store, you need to select your required items from the product information page(s) they appear on. These pages can be accessed by selecting one of our main product categories, either from the top navigation bar or from the list of categories and sub-categories displayed on the left of your screen.
Mountain Goat Performance Ltd will confirm receipt of your order by sending an email to you, using the address you supplied when registering with our website. This email is only an acknowledgement and does not constitute legal acceptance by us of your order.
All orders placed on our website are subject to stock availability and to the validation checks described in section 4 below. Also please refer to section 1 above regarding incorrect prices. No contract will exist until payment has been received and goods have been dispatched. This will be deemed to be our acceptance of your order and to have been effectively communicated to you.

5. Payment
We accept payment by most major credit or debit cards registered at UK addresses.
We regret that we are unable to accept payment by cheque, cash or any other form of payment other than credit or debit cards unless by prior arrangement. Please contact us at sales@mountaingoatperformance.eu We reserve the right to refuse any order on any basis without prior notification to the purchaser. In these circumstance and in all cases except fraud, we will refund all monies paid in full.
6. Validation Checks
All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
In addition, in the interests of preventing fraudulent use of credit, debit and charge cards, Mountain Goat Performance may validate the names, addresses and other information supplied during the order process against commercially available records (e.g Electoral Roll data, Credit Reference Services). A third party may also be instructed to complete these checks. By ordering from the Mountain Goat Performance website you consent to such checks being made. We may need to contact you by letter, telephone or email to verify details before we are able to process and dispatch your order or we may be unable to accept your order. Any information given may be disclosed to a registered Credit Reference Agency which may keep a record of the information. All information provided will be treated in accordance with the Data Protection Act 1998. These measures are taken as extra protection for you, to ensure your online shopping experience with us is as safe and secure as possible.
7. Liability
The majority of card issuers cover all the charges that may result from unauthorised use of your credit card or debit cards, but some may limit your liability to £50. If you believe your credit or debit card has been subject to unauthorised use you should contact your card issuer without delay.
8. Delivery
Our free delivery promise only applies to orders placed for delivery in mainland Britain. For deliveries to non-mainland UK addresses and certain remote locations e.g. Scottish Isles, Isle of Man, Isle of Wight, Northern Ireland and the Scottish Highlands there may be an additional surcharge imposed by our carriers and a slightly longer delivery lead-time. Any charge will be shown clearly during the checkout process or we will contact after the order has been placed. If you do not choose to accept the additional delivery charges, we will be unable to supply your product. Goods can be delivered either to your home address, to an alternative address or to your work. Please contact us prior to ordering if you live in the Channel Islands to ensure we do not have any issues with VAT.
Your order will be delivered either by Royal Mail, Royal Mail Recorded Delivery or by courier. A signature is required for all Royal Mail Recorded Delivery and courier deliveries.
If your order contains more than one product the individual products may, on occasions, be sent on multiple dispatches at no extra charge.
9a. Delivery Charges
The delivery charge for each item is listed on the product detail page underneath the ’Add to Basket’ button. If there is no delivery charge stated, and you live in mainland Britain, there will be no delivery charge. When you add products to your shopping basket the appropriate charge will be added automatically. All applicable delivery charges will be shown clearly throughout the checkout process.
Many of our suppliers are based overseas which can lead to delays in delivery to us. We will notify you if your order is held up by a third party as outlined in section 2: The contract.
9b. Delivery Times
Delivery times are as stated on the product page. Delivery can vary between next day and up to 6 weeks depending on the product. It is important that you read the delivery times before you order. If you order a product which has a clearly stated lead time, you cannot cancel the order on this basis.
We do everything we can to meet the delivery time specified in this section, however occasionally delivery times may be affected by factors beyond our control and cannot be guaranteed. We will inform you if we become aware of an unexpected delay. In the event that we fail to meet a specified delivery date you will have the option of either cancelling your order and receiving a full refund, or continuing with the order and accepting a refund of any additional delivery charge we have made.
Risk in the goods will pass to you on delivery.
We reserve the right to alter or amend delivery times in exceptional circumstances.

10. After sales care and guarantees
Where applicable, details of manufacturers' guarantees or service arrangements will be provided with the product. Specific warranty details by manufacturer can be found in manufacturers warranty section.
