§ 1 Scope of the contract
The following conditions govern the contractual relationship between the seller and the respective buyer on the eBay sales platform on the Internet.
The buyer is a consumer, as far as he concludes the contract for purposes that can be attributed predominantly neither his commercial nor his independent professional activity.
§ 2 Subject of the contract
The subject of the respective contract is the sale of goods by the seller to the buyer on the eBay sales platform, in particular the sale of virtual goods.
These goods are offered by the seller either through his eBay shop as a shop item or as a general auction item. General auction items are visible on both the seller's general eBay websites and the seller's eBay store.
The goods offered on the seller's general eBay websites or in the seller's eBay shop are binding offers by the seller to conclude a purchase agreement for the respective article.
§ 3 Conclusion of contract

The buyer can immediately buy goods offered via the seller's eBay shop or bid on these goods in an auction. Auction offers can also be linked to the Buy It Now option. The products and auctions of these goods offered in the seller's eBay shop in bid format Buy It Now are also visible on the general eBay websites. This does not apply to articles of the seller, which are intended by him exclusively as a shop article.
In the case of immediate purchase, an effective purchase contract for the Buy It Now price (fixed price) between the buyer and the seller is concluded when the buyer clicks the "Buy Now" button and then confirms. For fixed price items where the seller has selected the "immediate payment" option, the buyer accepts the offer by clicking the "Buy It Now" button and completing the immediately following payment process. The buyer may also accept offers for multiple items by placing the items in the shopping cart (if available) and completing the immediately subsequent payment transaction. Offers with the option "buy now" can also be purchased by the buyer as a guest without having to sign up for eBay. In this case, the buyer accepts the offer by clicking on the "Buy It Now" button, selecting the option "Buy as Guest" on the following login page under "Continue without registration" and concluding the immediately following payment transaction.
In an auction, an effective purchase contract is concluded with the buyer who has the highest bid within the offer period. The amount of the purchase price is based on this highest bid. A bid expires if another buyer submits a higher bid during the offer period.
If an auction offer is additionally provided with the Buy It Now option, an effective purchase contract for the purchase of the item, irrespective of the expiration of the offer period and without the execution of an auction, is already at the Buy It Now price (fixed price) if a buyer exercises this option , The option may be exercised by the buyer as long as no bid has been placed on the item or a minimum price as determined by the seller has not yet been reached.
If the seller offers his offer with a price suggestion function, buyers and sellers can negotiate the price for this article. In the submission of the price proposal by the buyer is then the binding offer and in the agreement of the seller with the price proposal the binding acceptance of the seller to see.
After the conclusion of the contract, the seller sends the buyer a confirmation and details of the purchase.
The contract text is not stored by the seller and can not be retrieved after the completion of an order process (for example, Buy It Now). However, the buyer can save or print the order data immediately before sending via the functions of his browser.
§ 4 Payment
The payment is made in advance (PayPal or bank transfer).
§ 5 Right of Withdrawal
If the buyer is a consumer, he is legally entitled to a 14-day right of withdrawal.

§ 6 Liability
The legal regulations apply.
All mentioned brand names are registered trademarks resp. Property of the respective companies and serve only for the product description. Data and contents are protected by copyright. Pokémon and the Pokémon Trading Card Game Online (PTCGO) are registered trademarks of The Pokémon Company International, Inc. or one of its affiliates. I make no claim to the virtual goods or other property of The Pokémon Company International, these are and will remain the property of The Pokémon Company International as well as all sorts of designations. I only provide the time needed to search and find those goods. Buyer is aware that by submitting an offer, trading in virtual items may result in account penalties or blockages under the terms and conditions of The Pokémon Company International. For this I assume no liability and no compensation in the form of money or other form is made.
§ 7 Final provisions
Contracts between the seller and the customer shall be governed by the law of the Federative Republic of Brazil, excluding the laws governing the international purchase of movable goods. This choice of law applies to consumers only insofar as the protection afforded by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn from the customer.
Should one or more clauses of these terms and conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
